This article presents a “glocal” method of comparative constitutional interpretation. In the debate on the judicial use of foreign ideas, transnationalists claim to propose a simultaneously global and local approach. However, they perpetuate the methodological nationalism of globalists and localists by assuming nations as their primary units of analysis. In contrast, this article advances a truly glocal theory of judicial interpretation. The glocal is the product of a constant interplay between the global and the local, from the inception of an idea to its practical judicial application. This approach follows a three-step process. First, it provides a multiscale toolkit to demonstrate that ideas may have never been purely national in the first place but are the result of plural hybridizations. Second, it uncovers the units that generate and disseminate constitutional knowledge: trans-territorial networks united by thematically shared beliefs rather than by nationality or a global mission. Third, it equips judges with the ability to glocalize or customize the idea, not as an exercise of national differentiation but as a strategy to make it epistemically familiar and more politically appealing to the network. In this way, the article critically engages with the debate on constitutional transplants, challenging its nationalist bias.

Experiments were conducted in 1982, 1983, and 1984 to determine whether herbicides can effectively control weeds in annual statice (Limonium sinuatum Mill.) without reducing the marketability of the crop. A greenhouse evaluation of chlorpropham (1-methylethyl 3-chlorophenylcarbamate), napropamide [N,N-diethyl-2-(1-naphthalenyloxy)propanamide], EPTC (S-ethyl dipropyl carbamothioate), oxadiazon {3-[2,4-dichloro-5-(1-methylethoxy)phenyl]-5-(1,1-dimethylethyi)-1,3,4-oxadiazol-2-(3H)-one}, and trifluralin [2,6-dinitro-N,N-dipropyl-4-(trifluoromethyl)benzenamine] indicated that preemergence applications of the latter three herbicides resulted in the most effective weed control and least statice injury. Oxadiazon was the most effective for broadleaf and grass ed control in field-grown statice. Yield and quality were greatest in oxadiazon-treated plots and exceeded those of the handweeded controls. Annual statice was most sensitive to trifluralin.

This article explores the often neglected relationships between constitution-making (including amendment) mechanisms and constitutional-infringement mechanisms by focusing on the override as one of the possible tools to depart from a Constitution. The article suggests that there are two types of override: a ‘common law override’, which is not uniquely Canadian, and a ‘sunset override’. The common law override evolves in the judicial decisions of a given country when the courts require the legislature to explicitly take responsibility for an action. Under the common law override, we may couple together phenomena that are not typically connected, including a means of protecting common law rights, a judicial presumption against delegation of power to administrative agencies, and mechanisms of dealing with procedural or substantive legislative entrenchment. In contrast, the sunset override is a Canadian invention. For the tool to be part of the infringement mechanisms of a country's Constitution, it must be provided for explicitly in that Constitution, and its exercise must be temporary.

This article follows the various possible uses of the common law override. It shows that Israel has vast experience with the common law override which may shed light on Israel's future possible exploitation of the sunset override. The article then shows that Israel has adopted the sunset override following the Canadian example. When the Rabin government adopted the tool as part of an exchange deal with the ultra-orthodox religious political party Shas, the terms of the deal included Shas' acquiescence to the peace process in exchange for the Rabin government's use of the override to protect the religious status quo from judicial intervention. In addition, the Israeli justices played an active and unique role in the birth and formulation of the Israeli override. As has happened with the Canadian override, supposedly these circumstances should have made the override illegitimate in Israel. However, this article argues that it is not the political uses of the override that result in its lack of use. Rather, the determining factor is the override's compatibility with the constitution-making process in a given country. From a normative perspective, it is easier for the Israeli legislature to override its own earlier enactments, even those titled Basic Laws, than it is for the Canadian legislature to override the People's enactment of the Charter. Thus, it is expected that Israel might more freely deploy the sunset override were it to become a general mechanism embodied in the Basic Laws, while, in contrast, the sunset override has fallen into disuse in Canada.

Cognitive deficits were produced in rats by different methods of damaging the brain: chronic ingestion of alcohol, causing widespread damage to diffuse cholinergic and aminergic projection systems; lesions (by local injection of the excitotoxins, ibotenate, quisqualate, and AMPA) of the nuclei of origin of the forebrain cholinergic projection system (FCPS), which innervates the neocortex and hippocampal formation; transient cerebral ischaemia, producing focal damage especially in the CA1 pyramidal cells of the dorsal hippocampus; and lesions (by local injection of the neurotoxin, colchicine) of the granule cells of the dentate gyrus. Following chronic alcohol or lesions of the FCPS, transplants of cholinergically rich fetal brain tissue into the terminal areas (neocortex and/or hippocampus) restored performance almost to control levels, with a time course consistent with growth of the transplants and integration with host tissue; transplants of cholinergically poor fetal tissue (hippocampus) were without effect, as were transplants of cholinergically rich tissue into the region containing the nuclei of origin of the FCPS. Grafts of primary cells enriched in glia and cultured neuroblastoma cells into the terminal areas of the FCPS were equally effective, suggesting that there are multiple mechanisms by which neural transplants can restore cognitive function following diffuse cholinergic damage. In contrast, after ischaemia- or neurotoxin-induced damage to CA1 or dentate granule cells respectively, cholinergically rich fetal transplants into the damaged hippocampal formation were ineffective in restoring performance. After ischaemic damage, however, performance was restored by suspension grafts of CA1 cells but not by transplants containing CA3 pyramidal cells or granule cells; and after colchicine damage it was restored by solid grafts containing granule but not CA1 pyramidal cells. Furthermore, electrophysiological evidence has demonstrated functional, graft type-specific host-graft functional neuronal connectivity. Thus, restoration of cognitive function by neural transplants is possible after damage to either diffuse (cholinergic) or point-to-point (intrahippocampal) forebrain systems, but the transplant must be appropriate to the damage to be repaired. Because the different types of brain damage studied provide analogues of human alcoholic dementia, Alzheimer's disease, and heart attack, these results are encouraging with regard to the eventual application of neural transplant surgery to the treatment of cognitive deficits in humans.

The growth rate of two species of whip black corals belonging to the genera Cirrhipathes and Stichopathes has been evaluated in different experiments conducted in the Marine Park of Bunaken (Indonesia) for over one year. Unbranched, unpinnulated black corals result among the fastest growing colonial organisms, with maximal growth rates of 13.25 cm month−1 for Cirrhipathes cfr anguina and 1.3 cm month−1 for Stichopathes cfr maldivensis. Several observations made both on transplants and on natural colonies add new information on the growth strategy of black corals. The easy handling, the high rate of survivorship and the fast growth of transplants indicate that black corals can be successfully employed in the recovery projects of harvested reefs.

Objective: This study aims to examine the use of a radial artery graft for bypass of the maxillary artery (MA) to the supraclinoid internal carotid artery (ICA) in treating ICA occlusions.

Study design and setting: This method was carried out on five adult cadaver sides. The MA was reached 1–2 cm inferior to the crista infratemporalis, following a frontotemporal craniotomy and a zygomatic arch osteotomy. Extradurally 2–3 cm lateral to the foramen rotundum, a hole was drilled in the sphenoid bone with a 4 mm tipped drill. A radial artery graft was passed through the hole to the inside of the dura. Before giving the infraorbital artery branch, the MA was dissected from the surrounding tissue and transected. The proximal end of the graft was anastomosed end-to-end with the MA and the distal end of the graft end-to-side with the supraclinoid ICA.

Results: The mean calibre of the MA was 2.6 ± 0.3 mm. The mean calibre of the proximal end of the radial artery graft was 2.5 ± 0.25 mm and the distal end was 2.35 ± 0.2 mm. The mean length of the radial artery graft was 4.0 ± 0.5cm.

Conclusion: This study suggested that the cases with ICA occlusion, which require high blood flow, may be treated as an alternative to current bypass methods requiring long vein grafts.

Using the outcrossing Primula farinosa and its autogamous selfing relatives P. scotica, P. scandinavica and P. stricta, we compared the fitness of light and heavy seeds. Heavy seeds germinated in greater numbers and more quickly. In competition with seedlings grown from lighter seeds, heavy seeds produced larger rosettes. In P. farinosa such seedlings went on to produce more seeds, and in two populations heavier seeds, than plants from lighter seeds. After transplantation to natural populations, seedlings of P. farinosa derived from heavy seeds produced larger rosettes, more flowers and seeds than those from lighter seeds in certain populations so that seedlings born of heavy seeds were much fitter than seedlings from lighter seeds. Average seed weight varied in inverse proportion to seed number per capsule. The autogamous species produced on average about twice as many seeds per capsule as P. farinosa. In P. scotica and P. stricta this difference appears to be due in part to assured fertilization, but this high fecundity did not cause disadvantageously light seeds. As these species produced fewer capsules per scape, their overall seed production was on average no greater than for P. farinosa. P. farinosa traded-off fitness between capsules with large seed numbers, which donated more offspring to the next generation, and those with small seed numbers, whose heavy seeds would be more likely to reproduce themselves in the next generation. We conclude that low fecundity in outcrossing species might at times be advantageous.

Three ectomycorrhizal legume trees, Microberlinia bisulcata, Tetraberlinia bifoliolata and T. moreliana, form discrete groves in the southern part of Korup National Park, in southwest Cameroon and contribute c. 45–70% of stand basal area locally in a matrix of otherwise species-rich arbuscular mycorrhizal forest. A transplant experiment was performed to assess the importance of ectomycorrhizal infection associated with proximity to parents in seedling establishment of the grove-forming species. Nonectomycorrhizal seedlings of the three species were transplanted into plots of two forest types, one of high (HEM, within-grove) and one of very low (LEM, outside the grove) abundance of all three species as adult trees. For two species (T. moreliana and M. bisulcata) there was no difference in survival over 16 months, but for the third (T. bifoliolata) survival was best in HEM forest, and correlated with the basal area of adult trees of ectomycorrhizal species. Only one species (T. moreliana) increased in biomass over the experimental period; the others declined. There was no effect of forest type on overall growth of any species, but the survivors of two (T. moreliana and M. bisulcata) had heavier stems in the HEM forest. Differences in survival and growth of transplants between the three species were in accord with the ecology of the species as inferred from the frequency distributions of adult tree size in the forest. Seedlings became infected with ectomycorrhizas in both forest types; where there was a difference in extent of infection (T. moreliana) this was not related to survival or growth; and where there was a difference in survival (T. bifoliolata) this was not related to extent of infection. These results confirm that mycorrhizal inoculum associated with conspecific adults is neither a prerequisite nor a guarantee of seedling establishment, but indicates that in some circumstances there might be benefits of being close to parents. Further research is required to unravel the complexities of ectomycorrhizal community structure in this spatially and temporally heterogeneous forest, and to clarify the extent to which the various hosts share ectomycorrhizal partners.
