  • Summary

    How did colonial rule gradually transform the legal systems of India? On what sources did the colonial administrators rely? In what ways did their focus on scriptural, religious sources frame and define the legal status of women in modern India? How was custom a challenge to early colonial formulations? Did the involvement of nationalist reformers substantially alter the reliance on scripture? How did early feminist interventions alter the picture? And which of these legacies continues to shape the legal status of women in contemporary India?

    The East India Company (EIC) first gained political and economic control over India when it was granted the revenues of Bengal in 1765. Since it was more than just the new landlord of this part of India, the Company was compelled to fashion a legal–juridical apparatus for its new dominions, primarily to ensure the steady and painless yield of revenues that it had been granted. Following the first flush of victory, the EIC discovered that this was no easy task. For one, the British had no real understanding of the agrarian systems of India and the range of rights that existed on land, which bore no resemblance to the relatively clear-cut alienability of land in Britain, which, as E. P. Thompson has shown, was itself only a recent development then. Also, British experience of the administration of its other colonies hardly prepared it for the first bewildering encounter with India and its many ‘non-state’ legal systems. In the colonies of North America and the Caribbean, according to Bernard Cohn, non-state legal systems were quickly replaced by state systems and, before long, were governed by institutions that were primarily an extension of the basic political and legal institutions of Britain. Indigenous populations of these colonies were quickly subjugated or simply massacred by earlier conquistadors, but India appeared to have recognizable institutions and codes which had the force of law, for which there were no British equivalents. Before long, it also became clear that Indian territories could not be governed without a better knowledge of the Indian languages of governance (Persian and Sanskrit) and ‘traditions’ and ‘local usages’ in addition to a detailed knowledge of the better-known legal texts on which the indigenous people appeared to rely.

  • Basque is a language of central importance to linguists because it is a 'language isolate,' a rare type of language that is typologically 'alone' and cannot be classified as a part of any language family. Language isolates remain somewhat a mystery, and this book aims to provide an important piece of the puzzle, by both exploring the structure of Basque and shedding new light on its unique place within the languages of the world. It meticulously examines various properties of Basque, including the alignment of intransitive verbs, the introduction of dative arguments, the nature of psych predicates, the causative/inchoative alternation, impersonals, and morphological causatives. By doing so, it presents a comprehensive overview of Basque's intricacies within the realm of argument structure alternations and voice. In its final chapter, it provides an introduction to potential formal analyses of the topics discussed, paving the way for future research in the field.   • In his 1797 essay 'On a Supposed Right to Lie from Love of Humanity', Kant argues that when only a confident lie might save a friend, one must, if asked, reply truthfully and thus betray his hiding-place to the person who wants to kill him. This is the first monograph to explore Kant's essay in detail. Jens Timmermann examines the background of the piece (Kant was provoked by Benjamin Constant and his translator, Carl Friedrich Cramer); the history of the example (which was also discussed by, amongst others, Augustine, Fichte and Johann David Michaelis); the peculiarities of Constant's version of the case; and Kant's core argument against Constant: lying, or a right to lie, would undermine contractual rights and spell disaster for all humanity. This rich, interpretative resource, which includes a facing-page translation of Kant's essay, will be of wide interest to Kant scholars and moral philosophers.

  • Using novel leadership data from eleven developed parliamentary democracies between 1980 and 2020, this Element asks how gender conditions party leaders' candidacy, selection, and survival. It examines the life cycle of party leadership careers of 276 leaders with a focus on three categories of variables: performance indicators, (s)election details, and inclusiveness of political culture. It tests the existing theories of glass ceilings and glass cliffs on how certain conditions make it more likely that women run for and are selected as party leaders. The Element also offers an original quicksand theory on leaders' survival in office that, for women, leadership is akin to being caught in quicksand. Several factors agitate the quicksand and make them sink faster. Their data show support for the glass ceiling and quicksand theories. Yet, they find mixed support for the glass-cliff theory. The Element offers unique insights into women's experience with party leadership.

  • This book explores the origins and evolution of China's institutions and communist totalitarianism in general. Contemporary China's fundamental institution is communist totalitarianism. Introducing the concept of “institutional genes” (IGs), the book examines how the IGs institutional genes of Soviet Russia merged with those of the Chinese imperial system, creating a durable totalitarian regime with Chinese characteristics – Regionally Administered Totalitarianism.   • This book is the first study of the persistence and significance of ancient lyric in imperial Greek culture. Redefining lyric reception as a phenomenon ranging from textual engagement with ancient poems to the appropriation of song traditions, Francesca Modini reconsiders the view of imperial culture (paideia) as dominated by Homer and fifth-century Attic literature. She argues that textual knowledge of lyric allowed imperial writers to show a more sophisticated level of paideia, and her analysis further reveals how lyric traditions mobilised distinctive discourses of self-fashioning, local identity, community-making and power crucial for Greeks under Rome. This is most evident in the works of Aelius Aristides, who reconfigured ancient lyric to shape his rhetorical persona and enhance his speeches to imperial communities.
